Terms of Service

Effective date: April 19, 2026

These Terms of Service govern your use of Arrivio by Ivrly, a guest communication platform operated by Ivrly, LLC, 2 Stanley Place, Far Hills, NJ 07931. By accessing or using the service, you agree to these terms.

1. The Service

Arrivio by Ivrly provides SMS-based guest communication tools for independent hospitality properties. The service includes a guest-facing digital welcome page, check-in instructions, local guides, dining recommendations, and related features delivered via SMS link.

2. Accounts and Access

You must provide accurate information when registering. You are responsible for maintaining the security of your account credentials. Ivrly, LLC reserves the right to suspend or terminate accounts that violate these terms.

3. Billing and Payment

The service is billed monthly at $5.00 per month, which includes up to 10 rooms. Additional rooms are billed at $0.50 per room per month. Pricing is subject to change with notice to active subscribers. New accounts include a free trial period before billing begins.

We offer a 30-day money-back guarantee. If you are not satisfied for any reason, contact us at hello@ivrly.com within 30 days of your first payment and we will issue a full refund automatically — no questions asked. Refunds are processed through Paddle, our Merchant of Record, and may take 5–10 business days to appear on your statement.

We will send you an email notification 5 days before your free trial ends and before each renewal charge. Billing is handled by Paddle, our Merchant of Record, who manages all VAT and tax obligations globally.

4. Acceptable Use

The service is intended for legitimate hospitality operations. You may not use the service to send unsolicited messages, spam, or any content that is illegal, harassing, or deceptive.

You are responsible for obtaining appropriate consent before sending SMS messages, in accordance with applicable laws including the TCPA (United States), GDPR (European Union), and equivalent regulations in your jurisdiction. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for help.

5. Your Data

You retain ownership of your property information, guest data, and message content. By using the service, you grant Ivrly, LLC a limited license to process this data solely for the purpose of providing the service. We do not sell your data to third parties.

6. Prohibited Jurisdictions

The service may not be used in countries subject to U.S. or international export restrictions. Use of the service from sanctioned jurisdictions is strictly prohibited.

7. Disclaimer of Warranties

The service is provided on an as-is and as-available basis, without warranties of any kind, express or implied. Ivrly, LLC does not warrant that the service will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the fullest extent permitted by law, Ivrly, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

9. Third-Party Services

The service relies on third-party providers including Twilio (SMS delivery), Paddle (billing), Supabase (database), Vercel (hosting), and Cloudflare R2 (storage). Your use of the service is also subject to their respective terms and policies.

10. Governing Law

These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

11. Changes to These Terms

We may update these terms from time to time. Continued use of the service after changes are posted constitutes acceptance of the revised terms. We will notify active users of material changes by email.

12. SMS Program Terms

This section applies to guests who receive SMS messages sent via the Arrivio by Ivrly platform on behalf of a hospitality property.

Program name: Arrivio by Ivrly

Message types: Transactional only — room details, photos, self check-in instructions, and local area guides. No marketing messages are ever sent.

Message frequency: Only upon direct request from the guest. SMS messages are sent solely when the guest has asked to receive property information via SMS.

Opt-in method: Guests provide consent voluntarily by completing the SMS opt-in form at https://ivrly.com/consent. The guest enters their name and mobile phone number and optionally checks a consent checkbox. Checking the box is not required — consent is entirely voluntary. If consent is given, the guest will be eligible to receive SMS messages. If consent is not given, no SMS messages will be sent.

How to opt out: Reply STOP to any message at any time to unsubscribe. You will receive a confirmation and no further messages will be sent.

Message and data rates: Message and data rates may apply depending on your mobile carrier and plan.

Privacy: Mobile phone numbers and opt-in data are used solely to deliver transactional stay-related messages. This information is never shared, sold, or disclosed to third parties for marketing or promotional purposes. See our Privacy Policy for full details.
